Please read these terms carefully before using MagikPay's services

Legal Compliance Terms Agreement

Eligibility


MagikPay provides INR payout infrastructure only to offshore licensed platforms, including:
• Gaming & casino operators
• Affiliate payout services
• Sportsbooks & fantasy leagues
• Crypto-based ecosystems

We do not onboard or support any platform licensed under Indian jurisdiction.


Nature of Services


MagikPay offers a technology interface for:
• Disbursing INR to Indian users via UPI, IMPS, NEFT, RTGS
• Settling inbound crypto (USDT, BTC, ETH) from offshore wallets
• Managing ledger, webhook, and compliance APIs

We are not a gaming platform, financial institution, or money transfer operator.


KYC, AML & Compliance


Clients agree to:
• Maintain full end-user KYC where legally required
• Adhere to transaction limits and user identity policies
• Not use the platform for unlawful, fraudulent, or sanctioned activities
• Submit platform details for pre-onboarding compliance checks

MagikPay reserves the right to suspend accounts violating compliance protocols.


API Usage & Access


• Access is granted via IP-restricted API keys
• You must protect your credentials from unauthorized access
• Sandbox and production credentials are separated
• Rate limits and webhook timeouts apply

Abuse of the API (e.g., spam, excessive retries) may result in throttling or termination.


Payout Terms


• All INR payouts are subject to liquidity availability and bank rail uptime • Crypto-to-INR rate is locked at time of transaction call • Settlement time typically ranges from 5 to 30 seconds • No guarantee is made for instant delivery in case of banking downtime


Pricing & Fees


• Fees are per transaction, and defined in your onboarding contract or SLA
• Volume-based discounts may apply for qualified partners
• Crypto conversion rates include spread and liquidity cost

MagikPay may adjust pricing with 7-day advance notice to live clients.


Service Availability & SLA


• Standard infrastructure SLA: 99.99% uptime
• Maintenance windows will be announced in advance
• Support provided via email and Slack (for enterprise plans)

MagikPay is not responsible for third-party disruptions (e.g., bank outages, blockchain congestion).


Limitation of Liability


To the extent permitted by law:
• MagikPay is not liable for losses arising from crypto volatility, user entry errors, or delayed disbursals caused by third parties
• Total liability is capped at the fees paid by the client in the last 30 days

Use of our platform is at your own risk.


Prohibited Use


Clients may not use MagikPay for:
• Indian-licensed gambling or betting
• Money laundering or terrorism financing
• Sanctioned jurisdictions (e.g., North Korea, Iran)
• Any activity violating Indian or international law


Governing Law


These Terms are governed by the laws of the Republic of Georgia (Tbilisi), where MagikPay is registered. Disputes shall be resolved via arbitration in English.


Termination


MagikPay may suspend or terminate services at its sole discretion if:
• Compliance breaches are detected
• Abuse or fraud is suspected
• KYC or legal documents are not maintained or updated

Clients may terminate usage by notifying us in writing with a 7-day notice.
